Scarnatti Returns and Refund Policy

At Scarnatti, we want you to be able to try your mattress at home with confidence. For this reason, we offer a 101-night trial period, which includes the statutory 14-day withdrawal period.

During the first 14 days, the statutory right of withdrawal applies. The voluntary 101-night trial period offered by Scarnatti covers a total of 101 nights from the date of delivery. It is not an additional 101-night period added after the statutory 14-day withdrawal period.

The statutory right of withdrawal and Scarnatti's voluntary 101-night trial period have a different legal nature. The voluntary right offered by Scarnatti does not restrict the consumer's statutory rights in any way.

1. Statutory Right of Withdrawal, 14 Days

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, takes physical possession of the goods.

Where several goods within one order are delivered at different times, the start of the statutory withdrawal period is determined in accordance with the applicable legal rules.

How to Exercise the Right of Withdrawal

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear statement.

You may notify us by email or letter. You may also use the model withdrawal form set out below. Use of the form is not mandatory.

You may also use the contract withdrawal link in the footer of our website to access the electronic form directly and submit your withdrawal quickly.

If you use this electronic function, you will promptly receive confirmation of receipt of your statement on a durable medium, for example by email, including the content, date and time.

To meet the withdrawal deadline, it is sufficient to send your statement before the withdrawal period expires.

Effects of Withdrawal

If you validly withdraw from this contract, we will refund the payments received from you, including the cost of the least expensive standard delivery method offered by us.

Additional costs resulting from your choice of a delivery method other than our least expensive standard delivery option do not have to be refunded.

The refund will be made in accordance with the applicable legal provisions.

Unless expressly agreed otherwise, we will use the same payment method that you used for the original transaction. You will not incur any additional fees for the refund.

We may withhold the refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first. Where collection of the goods is arranged by us, the applicable legal provisions apply.

Return Shipping Costs

Scarnatti covers the cost of return shipping.

Please contact us. We will provide a free return method and, where necessary, a return label or collection option.

Using the return method provided by us makes the process easier. It does not restrict the validity of your statutory right of withdrawal.

Loss in Value Under the Statutory Right of Withdrawal

You are only liable for any diminished value of the goods where that loss in value results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Special Note for Mattresses

Opening the packaging or removing protective wrapping from a mattress does not, by itself, result in the loss of the statutory right of withdrawal.

Although statutory exceptions to the right of withdrawal may exist for certain sealed goods for health protection or hygiene reasons, such an exception is not automatically applied to mattresses.

The statutory right of withdrawal for a mattress purchased online therefore does not lapse solely because the packaging has been opened or the protective wrapping has been removed.

2. Scarnatti Voluntary 101-Night Trial Period

2.1 One-Time Grant of the Right

The Scarnatti 101-night trial period is a voluntary right granted to the customer once only.

This right cannot be used again through the same person, the same customer account, the same household, the same delivery address, or through connected new or different orders.

A different size, a different model, a different order, a different purchase date, an exchange, or a later new order does not create a new 101-night trial period.

Purchasing multiple mattresses by the same person or household does not create a separate 101-night trial period for each mattress. The right under this programme can be used once.

This limitation does not affect statutory withdrawal rights, statutory rights relating to defects, or any other mandatory consumer rights.

2.2 Scope of the 101-Night Trial Period

Scarnatti offers a total 101-night trial period from the date of delivery for mattresses.

The first 14 days of this total 101-night period also fall within the statutory withdrawal period.

The 101-night trial period is therefore not an additional 101 nights on top of the statutory 14 days. The total period is 101 nights from delivery.

After the statutory 14-day withdrawal period has expired, the remaining period continues as a voluntary commercial return right offered by Scarnatti.

2.3 Effect of Use, Opening and Original Packaging on the One-Time Nature of the Right

The 101-night trial period is granted by Scarnatti once as a voluntary trial right.

For the purpose of determining whether this right has been used, it does not matter whether the mattress:

• has been used or not used at all,
• has been slept on or not slept on,
• has been opened or has remained unopened,
• has been removed from the vacuum packaging or left inside it,
• still has the complete original packaging or the original packaging is missing or damaged.

For example, if a mattress is returned unopened under the 101-night trial period, the one-time right granted by Scarnatti is still considered to have been used.

After such a return, a later purchase of another Scarnatti mattress by the same person, the same household, or through a connected order does not automatically start a new 101-night trial period.

Scarnatti may expressly grant a new trial period in an individual case.

This rule applies only to Scarnatti's voluntary 101-night trial period. Statutory consumer rights remain unaffected.

2.4 Start and Duration

The 101-night trial period begins on the date the mattress is delivered.

The return request must be communicated to Scarnatti no later than within the 101-night trial period.

It is sufficient to inform us of your return request before the period expires. The actual return shipment may then take place in accordance with the return instructions provided by Scarnatti.

Purchasing multiple mattresses does not create a separate new 101-night right or an independent start date for each mattress. The rules on the one-time use of the programme apply.

2.5 How to Start a Return Within 101 Nights

You can start your return request under the 101-night trial period in two ways.

Quick Return

Using the contract withdrawal link in the footer of the Scarnatti website, you can access the electronic form directly and submit a return request quickly.

Through the form, you can provide your name, email address, order number and information about the product you wish to return.

If the request is submitted within the statutory 14-day withdrawal period, it will be handled under the statutory right of withdrawal.

If the statutory 14-day withdrawal period has already expired, but the total 101-night period from delivery has not yet ended and the conditions of this policy are met, the request will be handled as a return request under Scarnatti's voluntary 101-night trial period.

When submitting a request by email, please provide the following information where possible:

1. order number,
2. name of the person who placed the order,
3. a short description of your return request.

Providing a reason for the return helps us improve our products and service. However, you are not required to provide a reason in order to use the 101-night trial period.

After we receive your request and verify your order details, we will inform you of the next steps in the return process.

Where necessary, Scarnatti will provide a vacuum bag, packing instructions, a free return label or another suitable free return method.

2.6 Free Return

The standard return under the 101-night trial period is free of charge.

Depending on the return method, Scarnatti will provide the appropriate return materials or return method. This may include:

• a mattress vacuum bag,
• packing instructions,
• a prepaid return label,
• another free return method organised by Scarnatti.

The mattress will generally be vacuum packed, folded or rolled and packaged securely for transport.

The original packaging does not have to be available. However, the product must be prepared safely for transport in accordance with the return instructions provided by Scarnatti.

If the standard return method cannot be used because of the size of the product or logistical circumstances, Scarnatti may determine a suitable alternative return method.

2.7 Condition of the Mattress

The 101-night trial period is expressly intended to allow the mattress to be used normally and slept on.

Normal signs of use resulting from proper trial use do not, by themselves, prevent a return.

However, mattresses that have been damaged or seriously soiled beyond what can reasonably result from normal trial use may be excluded from the voluntary 101-night trial period.

This includes in particular:

• damage caused by liquids or bodily fluids,
• serious stains or heavy soiling,
• mould caused by improper use or storage,
• burn, cut or puncture damage,
• damage caused by pets or pests,
• intentional damage,
• exceptional mechanical stress,
• improper folding, cutting or modification of the mattress,
• other damage caused by misuse or use other than for its intended purpose.

The mattress must be returned complete, including its corresponding cover and essential components.

These conditions apply only to Scarnatti's voluntary 101-night trial period and do not restrict mandatory statutory consumer rights.

2.8 Processing the Return and Refund

For a properly completed return, receipt of the goods, inspection of the goods and the refund are three separate processing stages.

These stages do not take place at the same time.

The process generally works as follows:

First Stage, Receipt of the Goods

The returned mattress first arrives at the Scarnatti return location. A delivery confirmation in the tracking system does not mean that the mattress has already been inspected or that the refund has already been initiated.

Second Stage, Registration and Inspection

After receipt, the product is entered into the internal returns process and the necessary inspection is carried out.

Physical receipt at the warehouse and completion of the inspection are separate operational steps and may take place at different times.

Third Stage, Initiating the Refund

After the inspection has been completed and it has been confirmed that the return complies with the conditions of this policy, the refund is initiated.

You should therefore not expect the refund to be completed on the same day that the product is delivered to us.

Receipt of the product, inspection and initiation of the refund take place one after another and may together require a reasonable processing period.

After we have initiated the refund, the time required for the funds to appear in your account may additionally depend on the processing times of your bank, credit card company or payment provider.

The refund will generally be made using the same payment method used for the original order.

2.9 Exchange, New Order and Voluntary Upgrade

Changing to another Scarnatti model, a different size or a higher-value model during or after the trial period does not start a new 101-night trial period.

This applies in particular in the case of:

• model changes,
• size changes,
• upgrades,
• return of the previous product unopened,
• return of the previous product unused,
• placing a new order.

The 101-night trial period is granted once to the same person and household.

Scarnatti may expressly grant a new trial period in an individual case.

The statutory right of withdrawal, statutory rights relating to defects and rights under a commercial guarantee remain unaffected.

3. Difference Between Returns, Statutory Rights for Defects and Guarantee

The 101-night trial period is a voluntary Scarnatti service intended to allow you to test the mattress in terms of your personal sleeping and comfort experience.

If there is a defect or technical fault, you do not need to use the 101-night trial period.

Your statutory rights relating to defects and any rights under the Scarnatti commercial guarantee of durability exist independently of the 101-night trial period.
